Intellectual Property Policy

Horkastee operates an online marketplace where users can design and sell custom T-shirts and merchandise. We are committed to protecting intellectual property rights and strictly prohibit the creation or sale of products that infringe on copyrights, trademarks, or any other legal protections.

If you believe your intellectual property rights have been violated on the Horkastee platform, please follow the reporting procedure below.

A. Reporting Intellectual Property Infringement

  1. Content Removal:
Horkastee will remove or restrict access to any content (“Content”) if we receive a valid notice of potential infringement.
  2. Repeat Violations:
Users who repeatedly infringe may have their accounts permanently terminated.
  3. How to Submit an Infringement Notice:
Send the following details to our designated agent:
    • A description of the copyrighted work or other intellectual property, including registration numbers if available.
    • Identification of the infringing content, including:
      a) An explanation of how it infringes.
      b) The exact location (URL or other identifying details) on Horkastee.
    • Your full contact information: name, mailing address, phone number, and email.
    • A statement under penalty of perjury that the use of the content is unauthorized.
    • A declaration that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.
    • Your physical or electronic signature.

B. What Happens After We Receive an Infringement Notice

  • The reported content will be removed or its access restricted.
  • The user who posted the content will be notified.
  • Repeat infringers will have their content removed and accounts may be permanently closed.

C. Filing a Counter-Notice

If you believe your content was removed in error or that you have the legal right to use it, you may file a counter-notice containing:

  • A description of the removed content and its previous location on Horkastee.
  • A statement under penalty of perjury that you believe the removal was a mistake.
  • Your full contact information: name, mailing address, phone number, and email.
  • A declaration that you consent to the jurisdiction of the Federal Court in your district, or if outside the U.S., the jurisdiction where Horkastee operates.
  • Your physical or electronic signature.

If a valid counter-notice is submitted, we may forward it to the original complainant. Unless legal action is taken, the removed content may be restored within 10–14 business days.

Important: Under Section 512(f) of the DMCA, anyone who knowingly files a false infringement claim may be held liable for damages, including legal fees.
